Today, members of the Lawyers for Extinction Rebellion group, alongside comedians Mark Thomas and Heydon Prowse, issued a Judicial Review Pre-Action Protocol letter of claim to the Metropolitan Police Service (MPS)
The letter informs MPS of the group’s intention to form assemblies and protest in support of the Extinction Rebellion Autumn Uprising (‘XRAU’) on Friday 18 October and Saturday 19 October 2019.
Such an assembly challenges the MPS’s use of a section 14 order banning all protests related to Extinction Rebellion across London, as issued by the MPS on 14 October 2019
The letter, and assemblies are intended to highlight the potentially unlawful prohibition of any and all assemblies in support of XRAU around a vast area, the entire City of London and Greater London area, and invites the Commissioner of the MPS to rescind the unlawful section 14 notice
The court action and assemblies take place as part of the International Rebellion from 7 October 2019
At 11.51am, 16 October 2019, Lawyers from the group Lawyers for Extinction Rebellion, and comedians Mark Thomas and Hayden Prowse, filed a Judicial Review Pre-Action Protocol letter of claim with the Metropolitan Police’s Directorate of Legal Services.
These individuals are supporters of Extinction Rebellion (‘XR’) who intend to form an assembly and protest in support of the Extinction Rebellion Autumn Uprising (‘XRAU’) on Friday 18 October and Saturday 19 October 2019.
They intend to engage in the following assemblies:
A protest in support of the XRAU outside the Royal Courts of Justice on Friday 18 October 2019 from midday. This protest will include wearing XR logos, carrying XR flags/banners and handing out XR leaflets and the Lawyers for Extinction Rebellion Declaration of Rebellion. The location of this assembly has specifically been chosen to highlight concerns as to the proportionality, necessity and legality of the MPS policing operation concerning XRAU and to reach a large number of those in the legal profession who are being invited to support the declaration of rebellion and Lawyers for Extinction Rebellion.
A ‘workshop’ based assembly in front of Broadcasting House, Portland Place, London, W1A 1AA on the afternoon/early evening on 18 October 2019 at which Guy Taylor, Mark Thomas and Heydon Prowse intend to wear XR logos, carry XR flags/banners and hand out XR leaflets whilst advising attendees on the preparation of picnic baskets for use during medium-term XR demonstrations.
The “People’s Vote” demonstration on Saturday 19 October in central London. They intend to wear XR logos, carry XR flags/banners and hand out XR leaflets and the Lawyers for Extinction Rebellion declaration of rebellion.
The letter of claim and the intended assemblies are designed to challenge the conditions imposed in the unlaw imposition of Section 14 of the Public Order Act.

Government must tell the truth by declaring a climate and ecological emergency, working with other institutions to communicate the urgency for change.
Government must act now to halt biodiversity loss and reduce greenhouse gas emissions to net zero by 2025.
Government must create and be led by the decisions of a Citizens’ Assembly on climate and ecological justice.
